General Terms and Conditions of LZWIN Trading B.V

§1 Applicability to Businesses and Definitions of Terms

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in their version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity (§ 13 BGB - German Civil Code).

§2 Conclusion of a Contract, Storage of Contract Text

(2) In the event of a contract being concluded, the contract is formed with:

(3) The presentation of goods in our online shop does not represent a legally binding contractual offer on our part, but rather a non-binding invitation for the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to enter into a purchase contract.

(4) When an order is placed in our online shop, the following rules apply: The consumer makes a binding offer by successfully completing the ordering procedure provided in our online shop.

The order is made in the following steps:

1. Selection of the desired goods

2. Confirming by clicking the "Order" button

3. Reviewing the information in the shopping cart

4. Clicking the "Checkout" button

5. Logging into the online shop after registering and entering login details (email address and password)

6. Final review or correction of the entered data

7. Submitting the binding order by clicking the "Order with obligation to pay" or "Buy" button

Before submitting the binding order, the consumer can return to the page where the customer’s details are recorded and correct any input errors by using the "Back" button in their web browser or cancel the ordering process by closing the web browser. We confirm receipt of the order immediately via an automatically generated email ("Order Confirmation"). This email confirms acceptance of your offer.

(5) Storage of the contract text for orders via our online shop: We store the contract text and send you the order details and our General Terms and Conditions by email.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The prices listed include statutory VAT and other price components. Shipping costs, if applicable, are additional.

(2) The consumer can choose to pay by prepayment or credit card (Visa, Mastercard, American Express).

(3) If the consumer selects prepayment, they are obligated to pay the purchase price immediately after the contract is concluded.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. Delivery will be made within 5 business days at the latest. In the case of prepayment, the delivery period begins the day after the payment order is issued to the bank, and for all other payment methods, the day after the contract is concluded. If the delivery period ends on a Saturday, Sunday, or public holiday at the delivery location, the period is extended to the next business day.

(2) The risk of accidental loss or deterioration of the sold goods transfers to the buyer only upon the transfer of the goods to the buyer, even in cases of shipping purchases.

§5 Retention of Title

We retain ownership of the goods until full payment of the purchase price.

§6 Customer's Right of Withdrawal

Consumers have a right of withdrawal under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us:

by means of a clear statement (e.g., a letter sent by post, fax, or email) about your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.

Consequences of Withdrawal

If you withdraw from this contract, we are obliged to refund all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the most cost-effective standard delivery offered by us), without delay and no later than fourteen days from the day we receive notification of your withdrawal from this contract. For the refund, we will use the same means of payment that you used for the original transaction, unless explicitly agreed otherwise; in no case will you be charged fees for this refund.

We may withhold the refund until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods without delay and in any event no later than fourteen days from the day on which you informed us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired.

We will bear the cost of returning the goods.
